Court rejects Nnamdi Kanu’s no-case submission in terrorism trial

 

The Federal High Court in Abuja has rejected the no-case submission filed by Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), in his ongoing terrorism trial.
Justice James Omotosho ruled that the prosecution had established a prima facie case against Kanu, ordering him to enter his defense.
Kanu is facing a seven-count charge bordering on terrorism activities, including incitement and attempting to destabilize the country.
The court found that the prosecution’s evidence and exhibits raised serious allegations of Kanu’s involvement in terrorist activities, warranting him to defend himself.
Kanu’s legal team argued that the prosecution failed to link his statements to any acts of violence and that his broadcasts on Radio Biafra constituted legitimate political expression.
Omotosho in his ruling, emphasised that the ruling doesn’t imply Kanu’s guilt but rather gives him the opportunity to exhaust his chances of explaining himself.
The court has also ordered the Nigerian Medical Association (NMA) to form a committee of medical experts to assess Kanu’s health status and determine his fitness to stand trial.
The committee, comprising 8-10 members, including specialists like cardiologists and neurologists, will evaluate Kanu’s health condition and submit a report within 8 days.
The case has been adjourned to October 8, 2025, for consideration of the medical report and possible continuation of the trial.
If certified fit, Kanu’s defense would be given nine consecutive days to open and close its case, with proceedings to continue on an accelerated basis.
