The Federal High Court in Lagos on Friday resolved the long-running legal dispute over the authorship and ownership of the globally acclaimed gospel song Way Maker, affirming Nigerian gospel artiste Osinachi Joseph Egbu, popularly known as Sinach, as the sole copyright owner.
Justice A. Lewis-Allagoa ruled that Sinach remains the recognised author and owner of the hit song, which has gained international acclaim and received numerous awards since its release.
The legal battle began after Michael Oluwole, who produced the song for Sinach, filed a suit seeking recognition as a co-author and co-owner of the celebrated gospel track.
In the suit filed at the court, Oluwole claimed entitlement to a share of income from licences and assignments linked to the song, arguing that his contributions to the recording gave him ownership rights.
He also alleged infringement of his performer’s rights as the musician responsible for the instrumental elements behind the sound recording and sought N5 billion in damages.
The plaintiff further requested a perpetual injunction against Sinach, asking the court to recognise his claims over the ownership and commercial benefits associated with the song.
However, the court rejected the claims and upheld Sinach’s position that she remains the exclusive author and copyright owner of Way Maker, one of Nigeria’s most successful gospel exports.
The judgment brings an end to a dispute that attracted attention because of the song’s remarkable global influence, having become a popular worship anthem across churches and Christian communities worldwide.
